Terms of Use
Last updated: 27 August 2026
1. Accounts and authority
You must provide accurate and current information, be legally able to enter into this agreement, and have authority to act for any organisation named on the account. You are responsible for account credentials, authorised users, and activity performed through the account. Notify us promptly if you suspect unauthorised access.
2. Orders and service descriptions
The order page, selected configuration, checkout summary, invoice, and any written custom quote describe the purchased service. Availability, resources, locations, software, management level, migration scope, backups, and support coverage differ by plan. General marketing copy does not add a feature that is absent from the applicable order description.
An order is subject to payment, validation, stock or provider availability, and any identity or fraud checks reasonably required. We may reject or cancel an order and return the payment when we cannot safely or lawfully fulfil it.
3. Prices, taxes, billing, and renewal
Current price, billing period, tax, setup fee, discount, renewal terms, and due date are shown at checkout or on the invoice. Introductory pricing may differ from renewal pricing when this is disclosed with the order. You are responsible for authorised charges and for keeping billing and contact details current.
Recurring services may generate renewal invoices before expiration. Unless the order expressly includes automatic payment, receiving an invoice does not itself charge a payment method. Failure to pay by the due date may cause suspension, expiration, data loss, or a reactivation fee.
4. Cancellation and refunds
Our Refund & Cancellation Policy is the single source for refund windows, exclusions, and the request process. Cancelling renewal stops future renewal processing where possible; it does not automatically reverse a completed charge. Domain registrations, transfers, licences, and other completed third-party transactions may be irreversible.
5. Acceptable use
You must use services lawfully and must not use them to distribute malware, conduct fraud or phishing, send unsolicited bulk messages, attack or probe systems without permission, infringe rights, evade sanctions, host unlawful content, consume resources in a way that materially harms other users, or conceal the source of abuse. You must respond promptly to legitimate abuse and security notices concerning your service.
6. Domains and third-party services
Domain services are also governed by the relevant registrar, registry, and ICANN or ccTLD rules. Registration is not guaranteed until confirmed by the registry. You are responsible for accurate registrant data and timely renewal. Software licences, control panels, payment providers, and other third-party services may have additional terms that apply to their component.
7. Availability, maintenance, and backups
Services are provided on a reasonable-efforts basis unless the purchased plan includes a separate written service-level agreement. Maintenance, upstream-provider incidents, attacks, software faults, customer configuration, and events beyond reasonable control may affect availability. A reference to monitoring or a historical uptime figure is not an availability guarantee.
You are responsible for maintaining independent, tested backups suitable for your risk. If a plan includes provider backups, its order description controls the schedule, retention, and restore coverage. Provider backups are an additional recovery aid and not a substitute for your own copy.
8. Support and customer responsibilities
Support requests may be submitted around the clock. Response and resolution times depend on priority, complexity, service management level, and agent availability unless a written support commitment applies. You must provide sufficient, accurate diagnostic information and must not send passwords or private keys through insecure channels.
9. Suspension and termination
We may restrict, suspend, or terminate a service for non-payment, fraud, unlawful or harmful activity, material breach, urgent security risk, or a binding legal requirement. Where practical and safe, we will give notice and an opportunity to resolve the issue. Immediate action may be necessary to protect customers, networks, or third parties.
10. Privacy, legal requests, and communications
Our Privacy Policy explains how information is handled. We may preserve or disclose information where reasonably necessary to comply with valid legal process, enforce these terms, investigate fraud or abuse, or protect people and systems. We do not promise to disregard lawful court orders.
You agree that operational, billing, security, and policy notices may be sent to the account email or displayed in the client area. Keep those details current.
11. Liability and mandatory rights
To the extent permitted by law, neither party is liable for indirect, incidental, special, or consequential loss. Our aggregate liability arising from a service will not exceed the amount paid for that affected service during the three months before the event giving rise to the claim. This does not exclude liability that cannot lawfully be excluded or limit mandatory consumer rights.
12. Changes, governing law, and contact
We may update these terms prospectively as services or legal requirements change. The current version and date will be posted here, and material changes will be notified where required. Continued use after the effective date constitutes acceptance to the extent permitted by law.
These terms are governed by the laws of India, with courts having jurisdiction under applicable procedural law. For questions, email contact@atozserver.com or write to ScaleWithUS India, Saktigarh, Bongaon, North 24 Parganas, West Bengal 743235, India.
